Remote support by Computer Helper Pty. Ltd. terms & conditions:

 

NOTICE: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THE REMOTE SUPPORT SERVICES, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS BELOW, DO NOT ACCESS THE REMOTE SUPPORT SERVICES. These terms and conditions shall apply to all interactions between you and ComputerHelper Pty. Ltd. with respect to the Remote Support Services. ComputerHelper Pty. Ltd. reserves the right to discontinue Remote Support Services to you at any time.

You hereby authorize ComputerHelper Pty. Ltd. to remotely access your systems and data through your computer(s) to provide support services to you and your company (the "Remote Support Services"). Using remote control software, ComputerHelper Pty. Ltd. will have the ability to take control of your computer and evaluate reported support issues. Upon your request, the ComputerHelper Pty. Ltd. support representative will have the option, in his or her sole discretion and judgment, to take one or more actions, including, without limitation, the following:

a) If the problem can be fixed by you through verbal instruction from ComputerHelper Pty. Ltd. without the need for ComputerHelper Pty. Ltd. to obtain remote access, then ComputerHelper will use reasonable efforts to so instruct you and fix the problem;

b) If the problem resides with the software configuration of the computer, and can be corrected, ComputerHelper Pty. Ltd. will use reasonable efforts to make the necessary changes to the configuration; and

c) If ComputerHelper Pty. Ltd. reasonably determines that your data files must be downloaded in order to evaluate the problem and/or make more comprehensive changes, ComputerHelper may do so, but only with your prior permission.

You understand and acknowledge that in some cases ComputerHelper Pty. Ltd. may not be able to correct the reported support issue remotely. No refunds will be given for the time spent to identify the problem, attempts to correct it remotely.

Before using this service, you must warrant that you:

(i)                 are authorized to sign for and bind yourself and any other party on whose behalf you use the Service and

(ii)               agree for yourself and the contracting party to be bound by all of the terms of this agreement, including the disclaimer of warranty and limitation of liability sections set  in this agreement. If You do not agree to these Terms, You may not use the Remote Support Service.

(iii)             agree to pay the ComputerHelper Pty. Ltd. for the usage of the Remote Support Service according to Hourly Billing Schedule (see below)

 

Remote Support Service Rates: The rates and charges, per 30 Minute Increment, for the Service under this Agreement with 1 hour minimum charge. Remote support hourly rate: $77 inc. GST

Payments: Payments must be made by credit card via online “PayPal” system. ComputerHelper Pty. Ltd. reserves right to discontinue the Service and refer Subscriber to a collections agent of our choice in the even of non compliance with payment terms. All legal fees and charges will be arising from collection will be payable by the Subscriber.

THE PROVISION OF THE REMOTE SUPPORT SERVICES IS PROVIDED "AS IS" AND "AS AVAILABLE." ComputerHelper Pty. Ltd. EXPLICITLY DISCLAIMS ANY AND ALL WARRANTIES WITH RESPECT TO THE REMOTE SUPPORT SERVICES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR IMPLIED WARRANTY ARISING OUT OF COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE. THE USE OF REMOTE SUPPORT SERVICES DOES NOT RELIEVE YOU OF YOUR RESPONSIBILITY TO MAINTAIN AND VERIFY THE ACCURACY AND COMPLETENESS OF YOUR DATA.

ComputerHelper Pty. Ltd.  SHALL NOT HAVE ANY OBLIGATIONS OR BE LIABLE FOR ANY OF THE FOLLOWING: (a) errors, omissions, defects, deficiencies in, or nonconformity of, any data modified by it; (b) claims in tort, whether or not arising in whole or in part from ComputerHelper’s fault, negligence, strict liability or product liability; and (c) claims for any indirect, incidental, special or consequential damage or for any loss of data, service, profit or use, even if ComputerHelper Pty. Ltd. knows or should have known of the possibility of such damage or loss.
